When Debora Lipstadt published her book ”Denying the Holocaust” in 1993, Holocaust denier David Irving sues her for defamation. Since the burden of proof is on the defendant in civil action cases in the British legal system, Lipstadt’s lawyers have to prove that Irving twisted facts with bad intent. Their plan is to prove that Irving is a racist but not to debate the factuality of the Holocaust with him. DENIAL is based on Lipstadt’s book about the trial with Irving where delves into the lawyers decision not to have her speak in court or question any Shoah survivors. The film gives a lot of room to the conflict between Lipstadt and her lawyers and shows the battle between the rational male lawyers who urge not to have witnesses and instead want to pursue a purely evidence-based strategy and the irrational emotions of the historian who insists that the voices of the survivors have to be heard. Debora Lipstadt comes across as more irrational than necessary because of this which is accentuated by Rachel Weisz’s twitchy performance. More interesting are the trial protocols based on the cross-examinations in which Irving, played with a nasty mix of darkness, sliminess, and resentment by Timothy Spall, is taken to task by Lipstadt’s lawyers. Holocaust deniers like Irving and Leuchter were invited as guests in CDU district chapters in the 90s. Today the conspiracy theories can mostly be found in the dark corners of the internet. The topic has not become less current.
